The Latest News on GSP and ATPA/ATPDEA Renewal: November 5 is the date!

CBP sent out two messages on October 27 regarding the renewal of the GSP and the ATPA/TPDEA programs. There are no programming changes to comply with these renewals, but you MUST make some changes to your data files for the system to work correctly.

In addition, ASCI is developing two reports that can help you identify shipments that will be eligible for refund. These can also be used in your application for ATPA/ATPDEA refunds. If you are interested in purchasing these reports, please e-mail liz@asciofmiami.com, and we will contact you when they are ready.

Here's how to make sure your system is ready for the changes.

CSMS #11-000266 - GSP Extension

This message is reporting that filers will be able to file GSP-eligible entry summaries utilizing the SPI Code of "A" without the payment of duty for shipments entered or withdrawn from warehouse for consumption as of November 5, 2011.

If you remember, back in January you activated an indicator that would send the "A" code but also include the calculated duties. According to CBP, all those entries that were filed with the A will be automatically refunded. The message says to contact the port of entry for inquiries about the status of your refunds.

To update your system to stop calculating the duties for GSP entries, go to Resource Manager (or Applications Manager), Company Set-Up, Options and Interfaces (or Application Options). For Application ID, enter IP. Look for the question that says "Calculate duties for GSP Entries?" and enter NO for the response to that question. (In the graphical version, this question will be located on page 7 and in text mode, it will be located on page 5.)

Make sure to <Page Down> all the way through to the end of the program.

CSMS #11-000267 - ATPA/ATPDEA Extended with Retroactivity

The Andean Trade Preference Act and the Andean Trade Promotion and Drug Eradication Act were also extended through July 31, 2013, after having lapsed on February 12, 2011. These apply to Ecuador and Colombia. All duties paid to ATPA/ATPDEA-eligible merchandise are eligible for a refund, but you must follow the instructions given in the message.

On November 5, make sure that your Country File for those Colombia (CO) and Ecuador (EC) have an ending date of 07/31/2013 for the "J" SPI Code. Go to Import Procedures/ File Maintenance/ Country-Port-Fee/ Country File to update this field.
